从中美比较法视角检视《非法证据排除规定》的程序性规定

摘要

Chinese Exclusionary Rule on Illegal Evidence was inevitably affected by the American exclusionary rule. This paper studied several procedural provisions of Chinese Exclusionary Rule on Illegal Evidence from the perspective of comparative Law. The procedural provisions included the stage, start, burden and standard of proof and relief procedure of the exclusionary rule on illegal evidence. In this way the author expects to correctly understand the procedural provisions of the Chinese Exclusionary Rule on Illegal Evidence and improve its president procedural provisions by searching the suitable rules in Chinese context.%非法证据排除规则发源于美国法制,我国新近《非法证据排除规定》之立法难免受美国非法证据排除规则的影响。本文以中美非法证据排除规则的比较为视角,考察我国《非法证据排除规定》中关于证据排除的适用阶段、启动程序、证明责任与证明标准以及救济程序等程序性规定的立法内容,以期对我国《非法证据排除规定》相关内容进行准确认识和解读,并探求我国语境下应然的非法证据排除规则,进而谋求对其改进与完善之道。
