非典型性犯罪的学理探析及审判应用

摘要

Atypical crime is a kind of crime which is different from the traditional model of crime; it is neither equal to the abnormal crime,nor equal to the so-called new types of crime. Atypical crime is a type of crime which has not been familiar known to people. Its characteristic is that the whole crime course is not familiarly structured or not totally structured by the criminologists. The course of the formation of a-typical crime and its classification are much different from traditional crime. Trial applications and crime prevention are required to establish a new theoretical templates,with focus on individual cases.%非典型性犯罪是一种不同于传统犯罪模式的犯罪，既不等同于变态犯罪，也不单纯是所谓的新型犯罪。作为一种尚未被人们所熟知的犯罪类型，其最显著的特点在于犯罪人所实施的整个犯罪过程不具备或者不完全具备犯罪学家、刑法学家所熟悉的犯罪架构。非典型性犯罪的形成原因与传统犯罪存在较大差异，其分类方式亦有所不同，在审判应用及犯罪预防上都需建立新的理论模版，强调从个案入手。
