《中华人民共和国食品安全法》实施六周年回顾及成效述评--以风险监测和评估为例

         

摘要

《中华人民共和国食品安全法》自2009年颁布实施,至今已历时6年,其在解决食品安全问题所起到的作用和仍旧存在的问题是我们关注的焦点。风险监测和评估制度是在国际食品安全领域得到公认的预防食品问题的重要制度之一。我国《食品安全法》借鉴欧美国家已经十分成熟的食品安全风险监测和评估体系,专章规定了风险监测和评估制度,旨在将食品安全问题给群众带来的风险扼杀在萌芽期或降至最低。目前,国家正在对《食品安全法》进行修订,本文拟系统的梳理有关风险监测和评估制度的法律发展进程,以此为切入点对《食品安全法》进行回顾、总结,对《食品安全法》风险监测和评估制度实施6年以来的法律效果进行评议,并对其未来的发展和完善进行了展望。%The Food Safety Law of the People's Republic of China enacted in 2009, and it has lasted for 6 years. We should pay our close attention on its achievements and some shortages in the field of food safety is-sues. Risk monitoring and evaluation system is one of the important systems in the food safety problems and has been fitted by law in the international food safety field. Food safety risk monitoring and evaluation system from European and United States is already very mature. China’s The Food Safety Law also provisions of the risk monitoring and evaluation system. Its purpose is killing the risk of the food safety in the bud or reducing to a minimum. At present, because the country is carried out on the“food safety law”revision, so this article sys-tem combing the risk monitoring and evaluation system of legal development process and as the breakthrough point to The Food Safety Law was reviewed and summarized. The paper also comments on The Food Safety Law risk monitoring and evolution system of legal effect of six years and discusses about the improvement and development of The Food Safety Law.
