农民赖以生存的根本是土地，失去土地，如无相应的措施为依托，农民的基本生存权将受到威胁，其个人发展和集体发展权被阻断。文章从土地征收补偿中存在的公共利益与农民基本权利、眼前利益和长远利益、地方政府与农民利益之间存在博弈失衡的状态分析，从而提出通过立法，明确具体界定公共利益，不能界定的由享有地方立法权的人大在其职权范围内决定；修改土地管理法中土地补偿原则，按土地价值进行补偿；完善土地补偿方式；将节约合理用地、科学规划城市规模及城市发展系统工程建设作为对政府进行政绩考核的指标；严格依法办事，加强基层法制宣传；通过这些途径最终实现上述多种利益的相对平衡。%Land is the basis of the peasants otherwise peasants‟ rights will be threatened. this paper discusses the imbalance between the public interest and the peasants right, the immediate interests and long-term interests, farmers and local government interests from land expropriation compensation, proposing to define public interest, and those between local government and the peasants to determine the public interest, and those that not covered by local people‟s congress to modify land compensation rules and to compensate by land compensation laws concerned by taking wise use of land, scientifically planning city land to develop city progress as the key to city government efficiency assessment, and to administrate by law and local law propaganda to realize the accomplishment of the strategies above.
