法律适用视角下不动产善意取得之善意认定

         

摘要

The center component of bona fide acquisition of immovable property, or bona fide component is not defined in the Property Law of our country, which brought difficulty and bifurcation in application of law. In order to facilitate application of law and distinguish bona fide of bona fide acquisition of movable property, the definition of bona fide component of bona fide acquisition of immovable property should embody objectivity, presumption and singleness. The prof standard of the eliminate circumstances of bona fide should be clarified further in order to realize the unification of application of law. Grossly negligent fault should be included in the eliminating circumstances of bona fide because of fair and economics cost analysis. The definition time of bona fide is the time that immovable property has registered based on the application of explanation method theory.%《物权法》中欠缺对不动产善意取得之核心要件即善意要件的界定,由此产生法律适用的难点和分歧点。从有利法律适用及有效区分动产善意取得之善意的角度考虑,不动产善意取得之善意的认定标准应体现客观性、推定性和单一性;为实现法律适用的统一性,善意的排除情形及其证明标准应进一步予以明晰;基于法理公平考量和经济成本分析,善意的排除情形中应纳入"因重大过失而不知转让人无让与之处分权";借助解释方法论,善意的认定时点确定为登记完毕时较为合理。
