规制逾期举证行为的程序设计

摘要

Overdue proof for civil behavior have a significant impact,the parties will lead to delays in the proceedings overdue proof,waste of j udicial resources,the evidence raids,and other adverse consequences affecting substantive j ustice. New evidence related content on overdue Civil Procedure was amended to increase the burden of proof on the parties of the three overdue regulation manner in which such acts for regulation has an important role.However,the existing requirements is relatively simple,can not meet the actual case processing needs.Therefore,before and after the two engaged in regulatory aspects of the conduct of proof overdue procedures designed to maximize the protection of the legitimate interests of both parties to maintain j ustice and substantive j ustice proceedings unity.%逾期举证行为对民事诉讼的进行有重大影响，当事人逾期举证会导致诉讼拖延、浪费司法资源、证据突袭、影响实体公正等恶劣后果。新民诉法对逾期举证相关内容进行了修改，增加了对逾期举证当事人的三种规制方式，这对于规制此类行为具有重要作用。但是现有规定较为简单，不能满足实际案件处理需要。因此，可从事前和事后两个方面对规制逾期举证行为进行程序设计，以最大限度地保障双方当事人合法权益，维护诉讼程序正义和实体正义的统一。
