地方立法主体扩容问题研究

摘要

The third session of the Twelfth National People’ s Congress amended the Legislation Law. The alteration of Legislation Law granted Cities divided into districts the legislative authority and expanded the numbers of body that owned the local legislative power. This paper analyzed the constitutionality and necessity of Legislation Law granting legislative power to Cities divided into districts and po-tential problems caused by the alteration of Legislation Law. Meanwhile this paper presented some relevant solutions.%第十二届全国人民代表大会第三次会议通过了《关于修改〈中华人民共和国立法法〉的决定》。这次《立法法》修改的主要内容之一就是对地方立法主体进行扩容，即赋予了设区的市相关立法权。本文对《立法法》赋予设区的市立法权的合宪性和必要性问题进行分析，对《立法法》赋予设区的市立法权后可能带来的后果进行预测，并提出相应的解决措施。
