说服的逻辑——浅析模拟法庭教学中的逻辑应用

摘要

Moot court teaching is an important practical part of law teaching.In the moot court teaching,the purpose of proof is clear which on the subject of persuasion.And it has many subjects which is very strong.It can be suspended and is very real.So the emphasis and rule of logic application of moot court teaching has characteristic.Except the prerequisite support the conclusion,it emphasizes the relationship between prerequisite and conclusion and the acceptability of prerequisite and conclusion that is the persuasion of law proof.%模拟法庭教学是法学教育中重要的实践教学环节。在模拟法庭教学中,法律论证的目的明确,以说服为导向;多主体,对抗性强;动态化,可废止,具有似真性。因应以上特点,模拟法庭教学中的逻辑应用的侧重点和规则也具有鲜明特色,除前提对结论的支持度外,更强调前提和结论的相干性、前提的可接受性和结论的可接受性,即法律论证的说服力。
