论民间法语言的模糊性

摘要

The linguistic ambiguity in customary law is universal and contributive factors feature multiplicity. The ambiguity is positive in interpreting the expansion of norms of customary law, prgomoting the realization of the effectiveness of norms of customary law and functioning as a complement to the language of state law. The ambiguity also produces negative effect on the guidance of the norms, provides convenience for abusing social power and is unfavorable to moulding culture of customary law. In the current society, customary law is to properly make use of linguistic ambiguity based on seeking linguistic accuracy.%民间法语言的模糊性具有普遍性，其成因具有多元化特点。民间法语言的模糊性既有扩大民间法规范的解释力、促进民间法规范效力的实现、形成与国家法语言的互补等积极作用，也有消极影响规范的指引作用、为社会权力滥用提供方便、不利于民间法文化塑造等消极作用。面向现代社会的民间法应该在追求语言精确性的基础上，恰当运用语言的模糊性。
