论党的领导与社会主义法治的内在统一性

The leadership of the CCP is not only the most essential characteristics of the socialism with Chinese characteristics but also the fundamental guarantee of socialist rule of law. From the point of the view of the theory and practice of Chinese characteristic socialism rule of law, the leadership of the CCP and the socialist rule of law are consistent. It is historical rationality, form legitimacy, substantive rationality and practical rationality that the socialist rule of law must adhere to the leadership of the CCP. The leadership of the CCP must rely on the socialist rule of law: The ruling power of the CCP is a kind of state power which must be supervised by the rule of law; governing by law is the basic path to realize the leadership of the CCP; In accordance with party discipline and regulations is not only an important way to strengthen and improve the leadership of the CCP but also the connotation of the socialist rule of law.%党的领导是中国特色社会主义最本质的特征，是社会主义法治最根本的保证。从中国特色社会主义法治理论和实践两个角度看，党的领导和社会主义法治具有一致性。社会主义法治必须坚持党的领导具有历史合理性、形式合法性、实质合理性和实践合理性。党的领导必须依靠社会主义法治：党的执政权是一种国家权力，凡是国家权力都必须在法治轨道中运行；依法执政是实现党的领导的基本路径；依纪依规治党是加强和改进党的领导的重要途径，也是社会主义法治的内涵。
