轻罪刑事政策视野下我国监狱分类制度的完善

摘要

The fundamental demand directed at the prison treatments of minor criminal offenders by the criminal policy of minor offense is that the treatments are more lenient. In accordance with this demand, there should be prisons of low level of disciplinary measures and open prisons compatible with the characteristics of minor criminal offenders. However, as far as the prison setup of our country is concerned, not only the difference of the level of disciplinary measures is not taken into consideration fundamentally, but also the unity is stressed as regards the degree of precautionary measures. As for the prison classification of our country, in the future, according to the level of disciplinary measures, the prisons of our country should be classified into ones of the highest level, the high level, the medium level, the low level and open ones. The minor criminal offenders are mainly imprisoned in the last three kinds of prisons.%　　轻罪刑事政策对轻罪服刑人员监狱处遇的基本要求是“处遇更宽松”。这一要求落实在监狱分类上，就是要有适宜矫正轻罪服刑人员的中、低惩戒度监狱和开放式监狱。但我国的监狱设置不仅不重视惩戒程度的差异，而且还强调整齐划一，这使得我国的监狱设置缺乏针对性，尤其不利于轻罪服刑人员监狱处遇的现实需要。所以，我国应以轻罪刑事政策的要求为指针，借鉴国外监狱分类制度的通行做法，以惩戒程度为标准将监狱从纵向分为最高惩戒度监狱、高惩戒度监狱、中惩戒度监狱、低惩戒度监狱和开放式监狱五种，轻罪服刑人员主要在后三类监狱中服刑。
