清代法律制度的复原——对《清代的法律、社会与文化：民法的表达与实践》的解读

摘要

关于清代法律制度,＂民法的表达＂给我们描绘的是厌讼、无讼、息讼的（法律、社会与文化）图像。而＂民法的实践＂,即法律制度运作的实际,呈现的却是不同的图像,甚至相反的图像。欲对清代法律制度进行全面的理解,必须要同时考虑表达与实践两个层面,弄清两者之间的关系。最后在方法论上,作者采用的实证分析、以小见大、事实价值二分等写作方法都是非常值得学习的。%In the legal system of Qing dynasty,＂ the expression of the civil law＂ depicts us an image of no lawsuit in law,society and culture.While,＂the practice of the civil law＂,the reality of the law system＇s function,presents a different image,even a contrary image.In order to comprehend sufficiently the legal system of Qing dynasty,we should consider the two aspects of expression and practice,and clear their relationship.At last,in the methodology,the author use the methods of the positive analysis,seeing the wide from the narrow,dividing the face and value and so on,which are worth for us to learn.
