劳务派遣中职务作品著作权归属的认定

To solve the copyright .problem of office works in Dispatch services , we should clarify the labor relations and identify what the "units" refer to. On this basis, copyright owner can be determined according to the law of copyright. In this paper, with the introductory of constituent elements of office works, legal relationship in labor dispatch, the amending law of office works, the author identified the copyright ownership of labor dispatch service works. That is, it should point the labor units which is created with close to.%要解决劳务派遣中被派遣劳动者在用工单位所创作的职务作品著作权归属问题，必须厘清劳务派遣中的劳动关系、明确与作者相对应的“单位”所指，在此基础上才能依据著作权法律规范确定该类职务作品的著作权主体。在介绍职务作品构成要件、劳务派遣法律关系、职务作品修法内容等基础上，认为对劳务派遣中职务作品著作权归属的认定应指向职务作品有密切联系的用工单位。
