寻租行为在土地用途管制中的衍生路径及抑制

         

摘要

The purpose of this paper is to explore the derivation path of rent-seeking use and the control measures. Methods include retrospective analysis, case-study behavior in regulating the land approach and comprehensive induction. The results indicated that land use regulation may impare the benefits of private land property rights although it reduced the externalities of land market. Meanwhile, land use regulation may result in high economic rent. The rent-seeking behaviors under the current land use regulation could be divided into two types, i.e., exclusive rent-seeking and competitive rent-seeking. They have the common derivation paths and motivational factors. The paper concludes that the causes could be controlled effectively through the structural rationalization of the property rights, the promotion of the execution of land use regulation, the perfection of appeal mechanisms, regulation and the establishment of the institutional innovation platform, etc.%研究目的:探寻寻租行为在土地用途管制中的衍生路径及抑制措施。研究方法:现象溯源法、个案分析法和综合归纳法。研究结果:土地用途管制弱化了私人土地财产收益的最大化,在减少土地利用市场外部性的同时,产生了价格不菲的经济租。寻租行为在土地用途管制中的发生类型呈现出独占型寻租和竞争型寻租两种,但其有着共同的衍生路径和动因。研究结论:可以通过合理化财产权结构、提高土地用途管制制度的执行力、健全诉求机制和设置制度创新平台等措施对寻租行为进行抑制。
