利益均衡下农地整治权属关系调整的研究进展

             

摘要

研究目的:研究利益均衡下农地整治权属关系调整的发展动态,以探求适应新时期农村社会经济发展的权属管理的新机制。研究方法:文献研究、比较分析和系统分析方法。研究结果:发达国家在法律法规的保障下,通过赋予农民完整的土地权能、强化农民的有效参与、合理评定土地价值、开展权属登记工作等权属管理手段,有效治理农地细碎化并促进农业现代化。然而,中国农地整治仍囿于以工程技术手段改造土地物理属性,对协调土地资源重配过程中产生的利益变化重视不够,坚持以农民为核心、统筹兼顾利益主体的多元需求,是权属管理制度创新的关键。研究结论:权属管理要以“人地协调”为研究理念,以实现农地整治绩效最大化为研究目标,以农民利益保护为研究核心;要从制度设计和立法层面着手探寻多元利益主体的均衡路径,并从权属管理目标、主体、内容、方法、模式等方面进行制度改革,实现不同利益主体间的利益均衡。%The purpose of the paper is to analyze the research progress of property rights adjustment in rural land consolidation from the perspective of interest equilibrium, and to explore the property rights management mechanism adapting to rural social and economic development in the new era. Research methods include literature research, comparative analysis and system analysis. Research results show that property rights management measures are implemented e.g., giving farmers the complete land property rights, strengthening farmers’ effective participation, evaluating rural land value, carrying out property rights registration etc, under the laws and regulations, which are the main ways to solve rural land fragmentation and to promote agricultural modernization in developed countries. However, China’s rural land consolidation is still limited to transforming land by engineering technology, but less concerns about the interest change in the process of land resources reallocation. Therefore, taking farmers as the core and coordinating diverse needs of multiple stakeholders are the keys to innovate property rights management. The paper concludes that property rights adjustment should take human-land harmony for the concept, should take maximum performance achievement for the target, and should take protect the interests of farmers for the core; and it should explore the interest equilibrium path of multiple stakeholders by system design and legislation.
