学校试题著作权问题研究

Examination papers are completed through creative labours, generally they have higher originality. Original examination papers constitute works in the sense of copyright law. Examination papers of school should be protected in accordance with laws of our country. Published works of others may be fairly used to make examination papers, in which authorship may not be mentioned, and works of others may be altered without authorization of copyright holders, on conditions that fair conventions are followed. Under different circumstances, copyright of examination papers of school may belong to the school or the author. The provisions of copyright law of our country about the ascription of works created in the course of employment and commissioned works have some trouble when they regulate copyright of examination papers of school. School had better agree on ownership and usage ways of examination papers with the authors. Copyright holders shall exercise their copyright of examination papers of school in accordance with the law. But copyright of examination papers of school should be subject of certain restriction for the purpose of public interest.%试题是由命题人员经过创造性劳动完成的，一般具有较高的独创性。具有独创性的试题属于著作权法意义上的作品，学校试题著作权应受我国法律保护。学校试题的命制可以合理使用他人已经发表的作品，并且在遵循公平惯例，的条件一可以不注明出处，可以进行一定的改动。不同情形下学校试题著作权的归属不同，它可能属于学校，也可能属于命题人员。我国著作权法关于职务作品、委托作品著作权归属的规定在适用于学校试题时具有一定的不适应性实。践中学校最好与命题人员明确约定试题著作权的归属或使用方式。学校试题著作权人可以依法行使试题著作权，但是为了公共利益会受到一定的限制。
