经济法视角下的农村土地经营权流转问题研究

当前关于农村土地经营权流转的争论比较激烈，经济法赞成符合社会整体利益的流转。农地流转的市场化是基本方向，但应注意解决好市场失灵和政府失灵问题。要在经济法“提升社会效率、实现实质公平”这两大目标指引下完善立法，坚持适度干预和维护合理竞争原则，明确政府、社会中间层、市场主体的权利义务。%There is an intense debate on transferring right to farmland Management in China. Economic law approves farmland transferring which promotes social public interest. It can be expected that market-orient⁃ed transferring is a trend. We need to solve the problem of market failure and government failure. The goal of law is to improve social efficiency,achieve substantial fairness. Legislation should adhere to the principle of moderate intervention and reasonable competition. Legislation should define the rights and obli⁃gations of government,intermediary organization and trader.
