遗产管理制度的体系化研究

摘要

The system of estate administration in the Inheritance Law of our country is still not perfect at present.Thus it is nec-essary to establish it under the current background of rapid economic development,increasing accumulation of individual wealth and frequent disputes of inheritance.For this,we should clarity estate manager system or estate management system,define its meaning,investigate the theoretical basis,distinguish it from other related systems,and determine its own system structure.In so doing,research of the specific content of the system will have base material and the compilation of the Civil Code of Inherit-ance reference.%目前我国《继承法》尚无体系完善的遗产管理制度，在经济快速发展，财富积累日益增多，继承纠纷频发的现状下，有必要确立结构完善的遗产管理制度，厘清遗产管理人制度或遗产管理制度，界定其含义，考察其确立的理论基础，划分与其他相关制度的界限，确定其应有的体系结构，从而为该制度的具体内容研究提供基础素材，为民法典继承编的编撰提供参考。
