For years, legal scholars and university officials have addressed the distinctive circumstances surrounding individual freedoms on the campuses of American universities. At the heart of this debate is the need to ensure academic freedoms while providing a safe environment in which to learn. At issue are divisive topics and a massive array of ideas and beliefs that often spawn heated debates and controversy. In this dissertation, a current model policy on freedom of expression was developed for public institutions of higher education. Specific attention was given to the areas of campus protests, demonstrations, and speakers. Landmark and current case law was examined to clarify the unique debate involving the public expression of opinions and articulating these ideas in an orderly environment. A review of the literature carefully highlighted the unique practice, mission, and purpose of colleges and universities as organizations where freedoms to teach and learn must prevail.; Interviews were conducted with the leadership of prominent national organizations responsible for First Amendment and campus policy issues to identify universities having exemplary policies on free expression. Policies from these participating organizations were studied and carefully analyzed for language elements and policy components. From these components, a draft policy was formulated. Last, individuals recognized by the leadership of the national organization as experts in the field of First Amendment matters, educational law, and campus policy issues critiqued the draft statement and provided feedback to finalize an operational policy.; This study provides valuable guidance for today's college officials and practitioners. Supported by case law and the professional opinions of the expert review panelists, the model policy provides much needed structure to face the critical issues regarding free expression and the resulting outcomes.
