Integration of RCRA Closure with Decommissioning Criteria at the West Valley Demonstration Project

The West Valley Demonstration Project (WVDP) in West Valley, New York is being conducted by thernDepartment of Energy (DOE) under the WVDP Act (Public Law 96-368). The WVDP is being conducted on landrnowned by the New York State Energy Research and Development Authority (NYSERDA). The DOE has exclusivernuse of project facilities for the purpose of conducting the WVDP via a cooperative agreement.rnAs a project, the WVDP is now entering its decommissioning and closure phase. As a site about to undergorndecommissioning and closure, the WVDP is unique in that it is being carried out by an agency of the federalrngovernment, the U.S. Department of Energy (DOE), on property owned by the State of New YorkrnThis paper presents a strategy for integrating Resource Conservation and Recovery Act (RCRA) closure requirements with U.S. Nuclear Regulatory Commission (NRC) decommissioning criteria. It will discuss differences between standards-based (i.e., RCRA closure) and risk-based (i.e., decommissioning criteria) requirements; identify how these standards are currently anticipated to be integrated at the WVDP; and discuss the process being used tornresolve inherent differences.
