The energy industry is subject to multiple permitting requirements. Depending on the size, type, location, configuration, history, and future plans of a facility, one or more permitting programs may apply. These may include permitting programs for smaller sources covered by State Implementation Plans or federally mandated programs such as Non-attainment New Source Review (NSR), Prevention of Significant Deterioration (PSD), Title IV, and Title V. In order for a facility to achieve compliance, it must identify and adequately address all permitting requirements and comply with the resulting conditions. This paper focuses on the challenges environmental managers face maintaining compliance with all these requirements, and provides an update on the Bush Administration’s NSR policy.
