AIR PERMITTING CHALLENGES FACED BY THE ENERGY INDUSTRY

The energy industry is subject to multiple permitting requirements. Depending on thernsize, type, location, configuration, history, and future plans of a facility, one or morernpermitting programs may apply. These may include permitting programs for smallerrnsources covered by State Implementation Plans or federally mandated programs such asrnNon-attainment New Source Review (NSR), Prevention of Significant Deteriorationrn(PSD), Title IV, and Title V. In order for a facility to achieve compliance, it mustrnidentify and adequately address all permitting requirements and comply with the resultingrnconditions. This paper focuses on the challenges environmental managers facernmaintaining compliance with all these requirements, and provides an update on the BushrnAdministration’s NSR policy.
