The article presents the provisions of the new civil code referring to the constitutive elements and the subjects of possession. Also, a comparative analysis in the jurisprudential domain is made regarding the impact of both the constitutive elements of possession and its subjects in the generation of the state of fact of material possession of a civil good without having the real acquired right.
