If you could roll back the erosion and sediment control clock twenty-six or twenty-seven years, to just before the Phase 1 regulations came out, but include a robust intent to prevent pollution from a construction site due to earth moving and other construction activities, what would the contract documents prepared by the design professional and given to the contractor look like? Impossible, you say? Perhaps. Back then we included nothing, or at best precious little, to prevent pollution from a construction site. We looked upon it as a non-point source, thus not subject to regulation, and to force a contractor to control pollution in construction site run-off would have been seen as an "unnecessary7' expense. And, perhaps we looked on it a little as environmental extremism.
