Based on the character and different combinations of rights in various contracts, this paper distinguishes different types in the ways of realization of human capital property rights (RHCPR), analyzes and discusses through relevant literature the main factors in the choice of ways of RHCPR, and gives a theoretical model of relationships among concrete contextual factors in enterprises' practice, the ways of RHCPR, staff and enterprise performance. It also briefly analyzes match effects of concrete contextual factors (social systems, staff and enterprises' organization) and the ways of RHCPR.
