The proposal for a new directive on waste and the new directive on management of extractive waste

The paper deals with two connected European Directives. The first one is the proposal for a new Directive on waste and the final Directive on waste, the Directive 2006/12/EC. The second is the Directive on management of waste from the extractive industries, the Directive 2006/21/EC. The Directive 75/442/EEC, the Waste Framework Directive, as amended by Directive 91/156/EEC, The paper examines the proposal for a new directive on waste, the new directive 2006/12/EC and some case-laws of the EU Court of Justice, focusing the attention on two cases respectively concerning a quarry and a mine. The second Directive here examined establishes minimum requirements to improve the management of extractive waste. The management of such waste should be subject to the provisions of the Directive 75/442/EEC or of Directive 1999/31/EC on the landfill of waste, or any other relevant Community legislation, as is the case for waste generated at a prospecting, extraction or treatment site and transported to a location that is not a waste facility according to this Directive. The main technical aim of the Directive is to minimise the environmental and human health effects of polluted drainage from waste management facilities (heaps and tailings ponds).
