Disclosed is an isolated or recombinant nucleic acid molecule comprising a nucleotide sequence selected from the group consisting of: a) the nucleotide sequence of SEQ ID NOS: 13 or 28, or a complement thereof; b) a nucleotide sequence having at least 90% sequence identity to the nucleotide sequence of SEQ ID NOS: 13 or 28, or a complement thereof, wherein the polypeptide encoded by said nucleic acid molecule has glyphosate resistance activity; c) the herbicide resistance nucleotide sequence of the DNA insert of the plasmid deposited as Accession No. NRRL B-30917, or a complement thereof; d) a nucleotide sequence that encodes a polypeptide comprising the amino acid sequence of SEQ ID NO:14; and e) a nucleotide sequence encoding a polypeptide having at least 90% amino acid sequence identity to the amino acid sequence of SEQ ID NO:14, wherein said polypeptide has glyphosate resistance activity. Also disclosed are methods of using the nucleotides for conferring herbicide resistance or tolerance to bacteria, plants, plant cells, tissues and seeds
