Use of Small Business Administration Section 8(a) Contractors in Automatic DataProcessing Acquisitions

The overall objective of the audit was to determine whether DoD Components usedsmall businesses that qualify as minority firms under Section 8(a) of the Small Business Act solely to bypass requirements for full and open competition when acquiring ADP equipment. We also determined whether firms that procure ADP equipment for the Government were complying with the provisions of the Walsh-Healey Act that prohibit brokers from selling items to the Government. The audit also determined whether DoD Components were in compliance with the Brooks Act, which requires a DPA if the contract value exceeds the thresholds established in the FIRMR. The adequacy of internal controls applicable to the audit objectives was also reviewed. Audit Results. The audit determined that DOD Components were not following specific guidance for the effective use of the Section 8(a) Program.
