Judge dismisses organic growers' 'preemptive' lawsuit against Monsanto

A federal judge in New York City on Feb. 23 dismissed a "preemptive" lawsuit against Monsanto brought by the Organic Seed Growers and Trade Association (OSGATA) and numerous other organizations. Filed in March 2011, in the U.S. District Court for the Southern District of New York, the lawsuit, Organic Seed Growers and Trade Association (OSGATA) et al v. Monsanto et al, (11-2163), aims to protect the plaintiffs "from being accused of patent infringement should their crops ever become contaminated by Monsanto's genetically modified seed."
