Preemptive lawsuit by growers against Monsanto rejected

A federal appeals court, in Washington, D.C., on Monday affirmed a lower court's ruling to dismiss what's been described as a preemptive lawsuit to prevent Monsanto from suing farmers if traces of its patented genes are found in organic or other non-biotech crops. Originally filed in March 2011, the lawsuit (Organic Seed Growers and Trade Association (OSGATA) et al v. Monsanto etal, No. l:ll-cv-2163-NRB) aims to protect farmers "from being accused of patent infringement should their crops ever become contaminated by Monsanto's genetically modified seed."
