Appeals court upholds Benlate verdict

The 11th Circuit Court of Appeals, on Dec. 13, upheld a lower court ruling dismissing a lawsuit by a farmer who charged that use of the fungicide Benlate caused his cancer. The farmer, Guillermo Ramirez, argued that the jury's September 2010 verdict in the district court case was inconsistent because it found Benlate to be defective, but not the cause of his injuries.
