THE QUESTION of whether penalty charge notices should carry date of issue as well as date of contravention became a topic of conversation after appeals defeats for three London boroughs earlier this year. Barnet, Lambeth and Tower Hamlets all lost parking appeals because there was no date of issue on their penalty charge notices (PCNs). The Road Traffic Act 1991 states that the fine must be paid before the end of a 28-day period. Adjudicators in all the cases said that the absence of the date on tickets meant that drivers might not know how long they had to pay up. The rulings suggest that the date of contravention should appear on both the body of the PCN and the payment tear-off section.
