High Court Upholds Cross-State Pollution Rules Raising Gas Use

The US Supreme Court last week upheld regulations to rein in air pollution the wind blows across state boundaries, representing yet another deterrent for coal-fired power generation as natural gas continues to gain market share. At issue was the Cross-State Air Pollution Eule (CSAPR) — colloquially known as Casper — that would have required 28 states in the eastern, midwestern, and southern US to reduce emissions of nitrogen oxides (NOx) and sulfure dioxide (SO2) that can cross state lines.
