California Judge Denies Summary Judgment For ARCO, DuPont In Nuisance Suit

Santa Clara County Superior Court Judge James P. Kleinberg heard arguments on four motions filed by the lead paint and lead manufacturing defendants: a motion for summary judgment by DuPont; a motion for sanctions by Adantic Richfield Co. (ARCO), DuPont, NL Industries Inc. and The Sherwin-Williams Co. for the municipal plaintiffs' alleged repeated violations of a discovery order regarding the Response and Surveillance System for Childhood Lead Exposure (RASSCLE) databases; ARCO's motion for summary judgment on successorship liability; and ARCO's motion for summary judgment on the ground that the municipal plaintiff cannot prove causation-in-fact.
