NATIONAL ENERGY BOARD OF CANADA ENSURES THAT TRANSCANADA'S INTERIM RATES GOVERN GAS TRANSPORTATION FOR REST OF 2011

Late last week, Canada's National Energy Board (NEB) chose to block any possibility of further rate adjustments in 2011 by rejecting the application of TransCanada PipeLines Ltd. last May that proposed a final rate structure that would have raised the pipeline's Eastern toll 21"/GJ to C$2.45/Gj, compared with its C$2.24/Gj interim toll. Its Southwest zone toll would be C$2.07/Gj, up 18 cents from the C$1.89 interim rate. The NEB was particularly critical of TransCanada’s plan to adjust for the difference between its proposed final and interim rates and have shippers pay that differential in future years. Nor is the Board persuaded that it should set aside the governing settlement "on the grounds of frustration, mutual mistake, or lack of full disclosure." The Board finds that these grounds do not apply for the reasons stated by TransCanada in its reply submissions.
