The case ofR (on the application of Morge) v Hampshire County Council [2010] EWCA Civ 608 considers the meaning of "disturbance" of a protected species within Article 12(l)(b) of Directive 92/43 on the Protection of Natural Habitats (the 'Habitats Directive'). In 1969 the railway line between Fareham and Gosport in Hampshire was closed. It became overgrown with trees and shrubs and bats and badgers have inhabited the area. In 2009 Hampshire County Council granted 'Transport for South Hampshire' planning permission for a bus route along the old rail track. There were various objections to this and one objector, Mrs Vivienne Morge, unsuccessfully sought judicial review of the permission on the basis that it would disturb the bats and badgers creating a serious adverse impact on the environment.
