Staff, Administration Actively Negotiating On NDAA Export Control Provisions

Congressional staff and administration officials are actively working on legislative language relevant for the administration's export control reform initiative that could become part of the National Defense Authorization Act (NDAA) now being considered by the Senate. One aspect of the language deals with returning to the president the authority to determine the export control status of satellites, and one key issue under negotiation is how broadly to define the satellites and related items covered by the change. The authority to determine the export controls status of satellites now rests with Congress, which needs to reverse the law before the administration can alter the controls for satellites and related items that now fall under Category XV of the United States Munitions List (USML).
