My thesis is that the Uniform Guide-lines on Employee Selection Procedures (Equal Employment Opportunity Commission, Civil Service Commission, Department of Labor, & Department of Justice, 1978) are a tool of political advocacy, not a scientific document—and thus inconsistencies like those pointed out by McDaniel, Kepes, and Banks (2011) are inevitable. The Washington wisdom "follow the money" to industrial and organization psychology (1-0) practitioners means "follow the numbers" of eliminating adverse impact to achieve the political agenda of equal employment. This naked redistributive agenda is well served under the guise of guidelines ostensibly detailing the means to job-related equal opportunity when in fact EEO enforcement litigates validity as an obstacle to achieving equal employment.
