For many working in the UK highways sector, contracts are often seen as a necessary evil that has to be endured to win work and to get the job done. For lawyers and commercial managers, they are also an essential tool for ensuring that risks are properly identified and allocated and for protecting parties' respective interests. When drafted - and understood properly - a contract can be a great collaborative tool. For more than 20 years now, this is the approach that the Institution of Civil Engineers has sought to take with its (now not so) New Engineering Contract (NEC). Next month sees the latest step in the development of this form of contracting.
