I read the editorial by Dr Bogod [1] with interest and would like to comment. In discussing the cases of Kerr and Wooley and Roe, it was not made clear that these cases were heard before the advent of the Civil Procedure Rules, introduced in 1997 as a result of the Woolf reforms. Before this, experts were instructed by the relevant side and were expected to be supportive of whosoever was paying their fees. However, now the responsibility of experts is to the court and not to the person who has instructed them or is paying their fees.
