On April 12,2018, the Governor of Colorado signed into law Senate Bill 18-184, which allows operators of a one-time excavation project to obtain a special permit for the incidental extraction of construction materials. S. 18-184, 2018 Colo. Legis. Serv. ch. 132 (amending Colo. Rev. Stat. §§ 34-32.5-111, -125) (effective Aug. 8,2018). Under existing law, a one-time excavation project must obtain a construction materials permit from the Colorado Department of Natural Resources, Division of Reclamation, Mining and Safety.
