Central New York Oil and Gas Takes Another Stab At Convincing FERC, Anadarko and MMGS That Unique Service to Chief Oil And Gas Does Not Trigger 'Most Favored Nation' Clauses of Other Services

Central New York Oil And Gas Co. LLC (RP15-742), in response to an April 13 protest of Anadarko Energy Services Co. and MMGS Inc., again urged FERC to exercise its jurisdiction over CNYOG’s petition to remove uncertainty as to its most favored nations (MFN) clauses, just as the Commission did in Rockies Express. The back and forth stems from CNYOG’s petition for declaratory order dated 3/30/15. The central issue with CNYOG’s petition is whether the MFN clauses in certain agreements under two specific firm rate schedules (MARC I FTS and North-South FWS) would be triggered by services at a lower rate under a third firm rate schedule (FTS-2).
