Wetlands Permit Suit Allowed

The U.S.Court of Appeals for the District of Columbia reversed last month a lower court's dismissal of a lawsuit,challenging the U.S.Army Corps of Engineers' nationwide permitting rules for wetlands,allowing the suit to proceed (National Association of Home Builders v.U.S.Army Corps of Engineers,D.C.Cir.,No.04-5009,7/29/05).In reversing the 2003 decision of the U.S.District Court for the District of Columbia to dismiss the case,the Appeals court found that the challenged permits constituted final agency action,and,therefore,are subject to judicial review.The decision is significant to ILMA members,largely when modifying their facilities.
