Federal Trade Commission going to court over proposed Peabody- Arch joint venture

The Federal Trade Commission has filed an administrative complaint challenging a proposed joint venture between Peabody Energy and Arch Coal. The complaint alleges the transaction will eliminate competition between Peabody and Arch, the two major competitors left in the in the Powder River Basin. The FTC has also authorized staff to file a complaint for a temporary restraining order and preliminary injunction in the U.S. District Court for the Eastern District of Missouri “to maintain the status quo pending an administrative trial on the merits.”
