US court overturns EPA exemption on certain air rules

Washington-A US appeals court December 19 rejected a federal Environmental Protection Agency rule that exempts major sources of air pollution from normal emission standards during periods of startups, shutdowns and malfunctions. The agency imposed as an alternative "arguably less onerous requirements," the US Circuit Court of Appeals for the District of Columbia said in its ruling. The exemption violates Clean Air Act requirements that the SSM standard apply continuously, the court said.
