  • 摘要：灵肉二元一直是西方文学和西方哲学的核心议题，受制于伦理和宗教语境的主宰和束缚，在过往的文学叙事、宗教隐喻和哲学思辨中，肉体往往被认为是灵魂的桎梏和监狱，这一思想导致了清教主义思想的盛行，也使得身体沦为人类文明书面记载中一个面目模糊的存在。于是，身体在“德”与“礼”的束缚中进退无据，既没有理论话语的表达权，也没有现实存在的着陆场。但可感、可欲的身体却一直是人类思想的精神沃土，以梅洛•庞蒂为代表的身体哲学的凸显为身体存在的合理性提供了最有力的辩护。同时，中国哲学中身心一体的思想和马克思、恩格斯本人对生命本身的关注都为解决灵肉问题提供了新的理论资源。%Duality of flash and soul has been the core issue of western literature and western philosophy. In the contexts of ethics and religion, the body used to be considered the shackles and prison of the soul. This idea led to the prevalence of Puritanism, making the body absent of history and civilization’s record. So the body loses the right to express and does not exist in the field of reality. But the sensible and desirable body has been a fertile ground for the spirit of the human mind, with the body philosophy springing up and Merleau-Ponty’s thought becoming more important, rationality of body presence has been obtained the most powerful defense.
  • 摘要：Entrepreneurship group of migrant workers expands gradually, but their new ventures lack of competitive advantage which restricts their entrepreneurial performance and entrepreneurial quality. Enterprises’ competitive advantages mainly depend on their internal heterogeneous resources, but the lack of internal resources is often faced in the early stages of migrant worker entrepreneurship, and relations of social network become an important way for them to obtain the heterogeneous resources. This paper made an analysis framework of“network relationship, heterogeneous resources and competitive advantage” based on the view of network resource, used the survey data of migrant worker entrepreneurs to analyze the impact mechanism of migrant worker entrepreneur’s“emotional” relationship and“instrumental” relationship on competitive advantage of new ventures. Research results show that the“emotional” relationship plays a positive role in acquisition of heterogeneous human resources and financial resources;“instrumental relationship” plays a positive role in acquisition of heterogeneous human resources, technical resources and market resources; heterogeneous financial resources, technology resources and market resources have significant positive effect on competitive advantage of migrant worker entrepreneur’s new venture.%农民工创业群体逐渐壮大，但是农民工新创企业缺乏竞争优势，导致其创业绩效和创业质量受到很大制约。企业的竞争优势主要来自于企业内部的异质性资源，然而农民工创业者在创业之初往往受限于内部资源不足，社会关系成为新企业获取异质性资源的重要途径。为此，基于网络资源观，构建“网络关系—异质性资源—竞争优势”的分析框架，在对安徽、江西和江苏三省创业农民工进行实地调研的基础上，实证分析农民工创业者的“情感型”关系与“工具型”关系对其新创企业竞争优势的影响机理，以及相互间的匹配关系。研究发现：情感型关系能促进异质性人力资源和财务资源的获取；工具型关系能促进异质性人力资源、技术资源与市场资源的获取；财务资源、技术资源以及市场资源与企业竞争优势显著正相关。
  • 摘要：Based on the current situation of China’s ecological compensation institution and policy system, the authors use the ideas of the roadmap measure to analyze the needs and goals, core task, path and resource guarantee of the construction of China’s ecological compensation institution and policy system in the next five to ten years. The result shows that in order to achieve the construction of the ecological compensation institution and policy system, China should implement the following four strategies: multidimensional coordination, standardization, construction of discipline platform and multi-channel compensatory payment. In order to guarantee the implementation of these strategies, China should focus on the following three aspects: the promulgation of laws and regulations, the guarantee of funding, and the share of information. Through these measures, the ecological compensation institution and policy system that suit China’s basic conditions so as to achieve universal coverage, operate efficiently, and obtain sustainable development will be constructed, which will promote in an all-round way, coordinated, and sustainable economic and social development and help our nation achieve the goal of sustainable development.%借用路线图方法的分析思路，从中国生态补偿制度与政策体系建设现状和问题出发，系统分析了未来5~10年中国生态补偿制度与政策体系的建设需求和目标、核心任务、建设路径以及资源保障。研究表明，中国生态补偿制度与政策体系建设路径应实施多维协同联动、标准化、学科平台、补偿金多渠道等四大战略，并从法律法规、经费投入、信息共享等三个方面来保障战略的实施，以建成符合中国国情、全面覆盖、机制完善、运转高效、持续发展的生态补偿制度与政策体系，推动经济社会全面协调可持续发展，实现中华民族永续发展的建设目标。
  • 摘要：A series of problems have been in existence in China’s intellectual property injunction system for the lack of typed thinking and systematic building. For instance, the conceptual expression of injunction is not rigorous; some types of injunction are missing and its nature is unclear; the legislation system is chaotic; hypostatic review standards and procedure rules are not perfect, etc. Reconstructing China intellectual property injunction system from a typisierung perspective is beneficial to progressively perfect the intellectual property injunction system within the current legal structure. China should categorize the intellectual property injunction, properly position the nature selection of the legislative mode of four level which combine civil procedure law, tort liability law, intellectual property law and judicial interpretation as well as clear the entitative examination standards and the rules of procedure.%中国知识产权禁令制度由于缺乏类型化思考和体系化构建，目前存在禁令概念表述不严谨、禁令类型缺失、禁令性质定位模糊、立法体系混乱、审查标准和程序规则不完善等一系列问题。从类型化视角重构中国知识产权禁令制度，科学划分知识产权禁令的类型，合理定位知识产权禁令制度的性质，选择“民事诉讼法+侵权责任法+知识产权单行法+司法解释”的四元层级立法模式，明确不同类型知识产权禁令的实体审查标准和程序适用规则，将推进这一制度在中国现行法律体系内不断发展完善。
  • 摘要：Social stability is the precondition of sustainable development for a country. Social stability risk refers to the possibility of the incident which damages the social order and results in the stop of the normal political, economic and social activities. The risk events of social stability have the man-made and tool characteristics. Moreover, the risk ontology attempts to be remedied by the realism and constructivism from the actors’ perspectives. Based on the inherent requirements of the actors, the general model of behavior is abstracted; on the basis of which, the explanatory framework of “Satisfaction Failure” is extracted in view of the need hierarchy dynamics. In addition, the ability to integrate theories and explain experience problems of the proposed frame is investigated sufficiently.%社会稳定风险是指社会秩序遭受破坏、导致政治经济和社会生活无法正常进行的事件发生的可能性。社会稳定风险事件具有“人化属性”和“工具性”特点，从行动者视角可以调和现实主义和建构主义各执一面的风险本体观。基于行动者动机的内在需要可以抽象出行为产生的一般模型，从中提炼出基于需求层次动力学的“满足性失灵”解释框架，该框架支持相关的理论整合，同时对经验问题的动力因具有较强的解释力。
  • 摘要：the differences resources endowment and selective excitation lead to inequality of power distribution among the members. But if the fact that the power controlled by the leading members is lack of checks and balances, the power will be transformed from inequality to the situation of imbalance, members with little powers will face the risk of being cheated and stolen. To cope with the power unbalance situation, measurements must be taken. The members should take actions to fight for their rights and interests, and avoid hitchhike. Leading members should exert self-discipline and standardize the power and benefit all members. Also the government and village committees must exert suitable supervision. In addition, rules system, supervision mechanism, mediation mechanism and small organizations system must be founded.%在农民专业合作社的构建和运作中，资源要素差异导致了合作社的组织权力在大户和小户之间的不平等分配。如果大户所行使的权力缺乏制衡，那么小户权益和合作社的集体资源将面临被盗窃的风险，难以发挥合作社的正功能。为应对合作社权力运作的失衡态势，小户社员必须积极参与合作社运作的集体事务，保护和争取自身的合法权益；既要养成非正式的合作规范，又要构建合作社权力运作的制度规范、监督机制和冲突调解机制。
  • 摘要：The city Image can be spread widely by the visual form, which is the visual carrier of the spirit and core values of the city and the media of the Urban Vision Management. Based on the theory of design and management, starting from the city spirit and core values, the authors believe that the visual culture phenomenon is the basic factor of city management transforming to urban visual management; From the perspective of mind identity representation and management of visualization, this paper discusses the potential and feasibility of the city image management and from the perspective of city visual management, it suggests the standardized management which includes invisible image management and dominant management, and the unique form of differentiation management consisting of the difference form of city image strategy and visual identity.%城市形象以最为直接和最具普遍认同感的视觉形式进行传播，其视觉符号是城市精神与核心价值观的视觉载体，构成了城市视觉管理的物资媒介。以城市形象设计和城市管理理论为基点，从城市精神与核心价值观出发，提出视觉文化现象是城市管理向视觉管理转型的基本动因；从精神表征化与管理可视化角度，探讨城市形象视觉管理的潜能与可行性；从城市形象视觉管理形式角度，提出意象规范的隐形管理功能和形象规范的显性管理功能构成了规范化管理形式，以及形象战略定位差异与视觉识别差异所形成的独特的差异化管理形式。
  • 摘要：Conscious stylistic awareness and unrestrained imagination of Mo Yan have made the highly variable creation of his writings, and his fiction narrative art has gone from “playing tricks” to “planning large structures” steering for 30 years. Mo Yan was keen to form experiment, using a dazzling “trick” to declare his creative and pioneering modernity, however, as the reflection of the form experiment, Mo yan has consciously returned to the folk and the classic novels, and his attitude to “playing big structures” has decisively proclaimed his indigenous and traditional writing style. But from the “little tricks” to the “big structures”, people can easily find that the “big structures” includes a lot of “tricks”. In conclusion, in the process of returning to the traditional Mo Yan has maintained a pioneering work.%自觉的文体意识和天马行空的想象力使莫言的创作充满变数。30余年来，他小说的叙事艺术经历了从“玩小把戏”到“玩大结构”的转向。莫言曾经热衷于形式实验，他用令人眼花缭乱的“小把戏”宣告了自己创作的先锋性和现代性，但随着对形式实验的反思，莫言之后的创作自觉地向民间回归，向古典小说致敬，他以“玩大结构”的决然态度宣告了自己创作的本土性和传统性。但在从“小把戏”向“大结构”的转向中，人们不难发现他小说中的“大结构”包含很多“小把戏”，可以说，莫言在向传统回归的过程中一直保持着作品的先锋性。

Non-Some Du result from continuing to use some special yinqie of teachers of Confucian classics. The first is to mistake non-labeling phonetics for the prefixes, or labeling phonetics for the prefixes, mistake zhiyin of no-phonetic-notation for zhiyin of phonetic-notation. The second is to mistake zhiyin of no-phonetic-notation for zhiyin of phonetic-notation.
  • 摘要：Buddhism was popular in the Hellenistic Bactria, its reason depends on the extent of the Hellenistic, or its spread on the degree of the hellenistic.Milinda-pa ha responded to this situation, just as what Bactria Greek with Mili hope group and Milinda belived not because of Nagasena replied with a clever Buddhist wisdom and expressed a heartfelt admiration, on the contrary, because Nagasena replied and inherited the thought of Aristotle’s Philosophy. Milinda accepted Buddhism with a strong color of the Greek philosophy. This reflects the Greek culture and India culture, Buddhism culture in Bactria in a multiple dimension and perplexing fusion.%佛教之所以能够在希腊化的巴克特里亚流行，原因在于其一定程度上的希腊化，或者说是传播方式上一定程度的希腊化。《那先比丘经》的流传即反映了这一情况。作为巴克特里亚希腊人的沾弥利望群和弥兰王并不是因为那先比丘的回答具有多么高明的佛教智慧而心悦诚服，而是因为那先比丘的回答方式和回答内容与古希腊哲学有着密切的关系。弥兰王所接受的佛教带有浓厚的希腊哲学色彩，反映出了希腊文化与印度文化、佛教文化在巴克特里亚所出现的一种多重向度、错综复杂的融合情况。
  • 摘要：Mencius said in his sympathy theory, “everyone has apprehensiveness and sympathy”, but apprehensiveness doesn’t mean the beginning of benevolence, which is profound meaning. Apprehensiveness, with fear of death is the premise of sympathy and compassion that means subject should place himself in others’ position to imagine other painful experience. It is also the necessary condition to stimulate and present Liangzhi. Although Saints are not tempted by other things and plagued by pain, the sympathy for others should be built on the apprehensiveness and fear of death, which is the awareness and compassion on the finiteness for all life and the fear and worry for others.%孟子在阐述同情理论时说“人皆有怵惕恻隐之心”，但在归纳“仁之端”时只说“恻隐之心，仁之端也”，并未将“怵惕”算上，这是有深意的。怵惕恐惧、怀生畏死，是主体以自身的主观构境设身处地想象他者痛苦并产生同情恻隐之情的前提，是刺激良知并使其呈露的必要条件。“圣人”虽然“不动心”，不为痛苦困扰，但对他者的同情依然要建立在对死亡的恐惧与担忧之上，只是这种恐惧怵惕是对全体生命之有限性的觉察与悲悯，是为他者害怕与担忧。
  • 摘要：思想实验与物质实验同属于实验的范畴，有着相同的构成要素，相同的存在价值。在思想实验与物质实验的关系上，索伦森和麦卡利斯特认为它们在本质上是相同的，但波普尔和诺顿认为它们仅有部分相同，而马赫、库恩、布朗等人却认为它们完全不同。通过细致的比较研究可发现，二者在构成要素上总体相似，但两类实验在起点、现象以及实验的代表性等方面颇具差异性，存在着本质的区别。%In general, thought experiments and physical experiments belong to the same category of experiments. They have the same elements and the same value of existence. However, in the comparison between thought experiments and physical experiments, Sorensen and McAllister think that they are essentially the same, but Popper and Norton believe that they are partly the same, and Mach, kuhn, Brown content that they are completely different. Through careful comparative studies, we can find that they both have the same elements, but there are manifest differences in the starting point, the phenomenon, the links between the experimental results and the conclusions and the representation.
  • 摘要：我国现行宪法文本中存在着大量的“依照法律”的表述。通过宪法文本的解释方法，可以确定“依照法律”系指“依照全国人大及其常委会制定的规范性法律文件”，从中可以推断出我国宪法的内在逻辑，表明人民代表机关权威最高性和无限性。并由此可以推导出三个结论：人民代表机关无须法律制约；国家机关之间不存在充分的权力制约关系；宪法权利受法律的严格制约。%According to the analysis of and statistics on the text of the Constitution of the People’s Republic of China, this paper holds that there are a large number of expressions of “In Accordance With the Law” (IAWL). IAWL can be defined by a literal interpretation method and other methods of constitution in the constitution text. In essence, the constitutional logic of IAWL is that the authority of the representative organ of the people is the highest and unlimited, and it can make all kinds of laws represent the people as if it likes, and asks for the people and other organs to enforce these laws. Three corollaries can be found through the constitutional logic: (1) the representative organ of the people is in the non-constrained state, and law expansion is irresistible; (2) there are not sufficient restrict of power between national organs; and (3) constitutional rights is in the strict constraints of the law.
  • 摘要：随着数字技术的突飞猛进，传统版权保护法治已不再适应数字娱乐版权领域的发展。美国“云计算”和“数据流”技术的快速发展给数字娱乐版权保护法治带来新的研究视角。与个人计算机模式相比，“云计算”一方面更能有效地防止数字娱乐版权盗版行为，另一方面能为窘境中的数字版权理论提供新的路径。因此，美国相关法制研究的启示，对于完善我国数字娱乐版权制度具有十分重要的理论和实践意义。%With the soaring growth of digital technology, the traditional law of copyright protection has not adapted to the development of digital entertainment of copyright. However, in the United States, the dramatic development of “cloud computing” and “content streaming” has brought about a new perspective. Compared with the personal computer model, “cloud computing”, on the one hand, prevents more effectively from copyright piracy of digital entertainment, and on the other hand, provides a new path for developing digital rights theory through the dilemma. Therefore, related legal research on the United States can be of very important theoretical and practical significance for the improvement of digital entertainment copyright system in China.
  • 摘要：公平是对现存经济关系的观念化，与效率间的矛盾是社会基本矛盾在人头脑中的反映，本质上要求而且可以达到高度统一；而平等是一种道德理想乃至幻想，与效率间的矛盾是价值与事实、理想与现实、主观与客观之间的背离造成的。由于主观不能达之客观，平等与效率二者不可兼得。当前阶段应坚持公平优先，为经济的健康发展创建一个和谐有序的环境；与此同时，兼顾平等，为增强社会凝聚力提供道义基础。这是实现中国梦的内在要求。%Fairness is an idea reflecting the extant economical relations, the contradiction between which and efficiency is the social basic contradiction in the person brains’ reflection, which essentially requests and moreover to be allowed to achieve highly unifies; the equality is one kind of moral ideal or even fantasy, however, the contradiction between which and efficiency results from the departure between value and fact, ideal and reality. Because subjective cannot reach objectively, both the equality and the efficiency cannot be achieved. At the current stage, fairness should be persisted first to promote a harmonious and healthy economical development. At the same time, proper attention to equality should be paid to, in order to provide morality and justice foundation for the enhancement of society cohesive force. This is the intrinsic request to realize the ‘China Dream’.
  • 摘要：邓小平在探索中国特色社会主义道路的过程中，深入思考了人与自然的关系问题，他在继承马克思主义生态观的基础上，提出了以为民谋利为基点和归宿，科技进步为支撑，生态治理为保障，实现人口、资源、环境和经济社会协调持续发展为核心的生态环境思想。邓小平的生态环境思想至今闪耀着真理的光辉。%In the process of exploring the road of socialism with Chinese characteristics, Deng Xiaoping thought deeply about the problem of the relationship between human and nature. On the basis of Marxist ecological view, which Deng Xiaoping carried on, he put forward the idea of ecological environment which its basic point and the end-result was benefiting the people; its support was scientific and technological progress; its guarantee was ecological management, and its core was to realize coordinated and sustainable development in population, resources, environment, economy and society. Deng’s idea of ecological environment still shines with the brilliance of the truth.
  • 摘要：话本小说的形式结构类似于僧讲、俗讲仪式。小说中众多冥游故事，显示了冥游者从一种境况到另一种境况的转变，冥游成为冥游者成长过程的通过仪式。对冥游者的经历及冥游场景的描写，揭示了边缘人物作为“替罪羊”的必然性以及考验仪式对部分冥游者的必要性，冥府的恐怖也成为伸张正义的仪式象征。冥游不仅具有仪式功能，也具有文学功能，它实现了虚与实的交融，叙事时空的转换，巧合与必然的联系，实现了娱乐与恐惧情感的无缝结合，将庄严与狂欢融为一体。%The structure of Nihuaben novels is quite similar to ceremony forms of the monks’ narration and Su-jiang (俗讲) narration in temples. Many protagonists in the novels change from one situation to another through their tour in hell, and the peregrination becomes their rites of passage in the life. The protagonists’ experience and travel scene description reveal the edge characters as “scapegoat” and the test ceremony is a necessity for some tours, and the horrible views in the hell have also become the justice ritual symbols. All in all, hell visit has not only ceremonial functions, but also the function of literature, such as fictitious and real integration, conversion of narrative time and space, the coincidence relation and inevitable, seamless combination of entertainment and the sense of fear, the solemn and carnival atmosphere.
  • 摘要：“话语转向”作为文学理论从“现代”向“后现代”过渡中最重要的范式转换之一，在将文学置于开放性的外在向度的同时，也在一定程度上失落了对于文本结构本身的关注。作为伴随“话语转向”而兴起的一种新的学科架构与知识体系，后经典叙事学一方面将人们的视域延伸至更宽广的社会文化语境，一方面也不忘立足文本，对文本自身各要素的复杂关系加以审慎的梳理与细致的辨析，并为研究者提供了一系列切实而具体的文本解读方式。后经典叙事理论不仅矫正了当前文学研究对于文本本身的相对忽视，同时也缓和了文论转型中“语言”和“话语”两阶段之间的张力，从而在“话语转向”的总体背景下展现出了充分的生长可能。%“Discursive turn” is one of the most important transformations in the movement from “modern” to“postmodern” in literary theory. Placing literature into the open and external dimension of theoretical research, to a certain extent, discursive turn overlooks the texture and structure of the text. “Postclassical narratology” is a new disciplinary structure and knowledge system which emerged with the tendency of “discursive turn”. On the one hand,“postclassical narratology” extends people’ horizons to the broader dimension of society and culture. On the other hand, it mostly focuses on the complex relationships among elements of literary work, and provides a series of practical critical mode to researchers. Postclassical narratology not only corrects the contemporary prejudice of neglecting the text itself, but also eases the tension between “language” and “discourse” in the transformation of literary theory. In conclusion, postclassical narratology unfolds sufficient space of development under the general background of “discursive turn”.
  • 摘要：The formation of subjective degree adverb “he deng”, has gone through the process of phrase→pronoun→ adverb. As a pronoun, it began in Han Dynasty, influenced by Chinese Buddhist sutra. As an adverb, it began at the end of Yuan Dynasty and the beginning of Ming Dynasty, closely related with its tone function transformation and the changes and predication and modified ingredients. After the adverbialization, its function began to expand.%主观程度副词“何等”的形成，经历了由词组→代词→副词的过程。由词组而代词，成于汉代，深受汉译佛经的影响。由代词而副词，成于元末明初，与其所在句语气功能的转化以及所饰成分的述谓性变化有很大关联。副词化后的“何等”，功能也在不断地扩展。
  • 摘要：在心性工夫之学中，审美决不是“在外在对象之姿态万千与色彩缤纷中寻求好奇心的满足”，而是“与绝对的‘一’作存在的呼应，既而纯化自家生命，照亮乾坤、朗澈世界”。这样，审美就是一种内在的存养工夫。这种存养工夫的结果，其精神色泽必是素朴恬淡的。在此工夫中必然居有天、地、神、人共处于一物的圣域，这便是艺术的意境。故艺术不必抒情，不必叙事，亦不必说理，只须居有物“自身”。%In the science of mind kungfu, aesthetics is never “to seek the satisfaction of curiosity within the magnificence and colorfulness of external objects”, but “to echo with the absolute ‘One’ in existence, and then to purify one’s own life, and to illuminate and clarify the universe”. In this way, aesthetics is akind ofinherent kungfu of self-cultivation. This kungfu of self-cultivation gets the result that itsspiritual luster would be simple and tranquil, in which the Heaven, the Earth, God and human beings all get together. This is the artistic conception. Therefore, art is not necessary to express emotion or to narrate, or even to argue, and the only thing it may do is to have things in themselves.
  • 摘要：We could not realize Chinese dream without the ethical support. The socialist core value viewpoints have constructed common spiritual home of Chinese people from national ethics, institutional ethics, and civic ethics. The national ethics, whose value targets are prosperity, democracy, civilization and harmony, has established a country image of comprehensive modernization, which is a supporting force of idea and belief. The institutional ethics, whose value principles are freedom, equality, justice and the rule of law, has constructed a just social ideal, which is driving force of the system justice. The civic ethics, whose value demands are patriotism, dedication, integrity and kindness, has shaped an upright ideal citizen personality, which is an affinity of citizen virtue. It is an important measure to cultivate the socialist core value viewpoints for the improving of culture soft power, which has provided a powerful ethical support for the realization of the China dream.%实现中国梦离不开伦理的支撑。社会主义核心价值观从国家伦理、制度伦理、公民伦理三个层面建构了中华民族共同的精神家园。以富强、民主、文明、和谐为价值目标的国家伦理树立了一种全面现代化的国家形象，是一种理想信念的支撑力。以自由、平等、公正、法治为价值原则的制度伦理建构了一种公平正义、海晏河清的社会理想，是一种制度正义的驱动力。以爱国、敬业、诚信、友善为价值诉求的公民伦理塑造了一种顶天立地、正道直行的现代公民理想人格，是一种公民品格的亲和力。培育社会主义核心价值观是提高文化软实力一项重要举措，它为实现中国梦提供了强大的伦理支撑。
  • 摘要：Firstly, this paper analyzes the basic situation of the final anti-dumping measures that China has experienced; then it calculates ADI to make a comparative analysis of the strength status of the final anti-dumping measures China has experienced, and reveals the serious situation of the world’s final anti-dumping measures against China from different perspectives. From the overall perspective, China’s export market share has long been strongly suffered from the final anti-dumping measures, especially from 1995 to 1997. Though U.S. is the world’s major exporter, its global export market share has been little affected. From the country’s perspective, China’s export share has been most strongly suffered in the U.S. market, but this export share in the Indian market and EU market has not been most strongly affected. In the end, this paper proposes some policy recommendations including that China should set the short-term objective of lowering anti-dumping’s absolute impact and long-term objective of lowering anti-dumping’s relative impact, and actively participate in regional multilateral economic cooperation, and so on.%首先分析了中国遭受最终反倾销措施的基本状况，然后通过ADI数据的测算，对中国遭受最终反倾销措施的强度状况进行了比较分析，从不同的视角揭示世界对华实施最终反倾销措施的严峻形势。从总量视角上考察，中国的出口市场份额长期受到最终反倾销措施非常强烈的影响，1995—1997年期间影响尤为严重。美国虽是世界出口大国，但其在全球的出口市场份额受到的影响却很小。从国别视角上考察，在美国市场，中国的出口市场份额受到的影响最为强烈；在印度、欧盟市场，中国的出口市场份额受到的影响并不是最强烈的。最后，针对中国提出了降低反倾销绝对影响的短期目标和降低反倾销相对影响的长期目标、积极参加区域性多边经济合作等政策建议。
  • 摘要：我国“八二”宪法虽然明确规定了公民的受教育权利，但是教育平等权却是间接得来的。教育平等权的内涵虽在学界未达成共识，但应蕴含两类平等性原则：形式及实质之平等原则。我国宪法文本对教育平等之规定经历了从“入宪”到“删除”，随后从“再次入宪”到“强调权利属性的教育平等”之发展历程。实践中，更是因为教育平等权之法律文本缺位，使得公民应当平等享有的宪法基本权利受到本质的侵害。在思考教育资源公平配置且效益最大化的同时，提出教育平等权之宪法确认、教育平等权之宪法救济及其技术路径。%In 1982, the Constitutional text defined the citizen education rights clearly, but education equality was indirect. The connotation of education equality should contain two principles though there is no agreement: form and virtual principle of equality. Education equality in constitutional text changed from “writing into the constitution” to “deleting”, and from “again writing into the constitution” to “emphasizing education equality”. In practice, the absence of the legal text makes the equal right of the citizens violated. We should think about the education resources and fair allocation of the maximum profits. At the same time, we should put forward constitutional confirmation, constitutional relief, and take technological path of the education equality.
  • 摘要：In the period of the early period of the Republic of China, the criminal trial law was relatively stable but not complete, so the sources of criminal trial law was plural. In order to make the law effective and maintain fair, the then Daliyuan, as the highest judicial organ, used its power of interpretation, and established a large number of precedents and interpretation cases, which became important legal basis in this period. This is an authoritative criminal judicial creation which reflected the nature of the jurisdiction with effect and played the role of uniform law.%北洋政府时期，刑事审判法律相对稳定然而并不完备，导致刑事审判法律渊源的多元化。为了有效适用法律，维护刑事审判的公正，作为最高审判机关的大理院通过司法创制的形式确立了大量判例和解释例，成为这一时期刑事案件审判的重要法律依据。这种体现司法权本质的司法创制具有拘束个案的效力，并起到统一法律的作用，具有相当的权威性。
  • 摘要：伴随着玻利维亚、厄瓜多尔和委内瑞拉三个拉美国家相继通知退出ICSID公约，国际法理论界与实务界在理解与适用ICSID公约的退出条款问题上产生了分歧。究其原因，对公约第72条中的“同意”一词理解不同乃关键所在。ICSID公约第72条中的“同意”应被解释为“同意要约”或“单方同意”。东道国受ICSID管辖的“同意”一旦做出，即成为其一项强制性的国际义务，该“同意要约”具有不可撤销性。退出国在通知退出前所作的受ICSID管辖的“同意要约”非但在退出前有效，而且在通知退出与退出生效之间的“缓冲期”内仍能保持效力，即便退出ICSID公约生效后，依然有效。但有权“接受”退出国“同意要约”的投资必须为东道国退出ICSID公约生效前已进行的投资。%The three Latin American countries, namely Bolivia, Ecuador and Venezuela, successively denounced the ICSID Convention, international law theorists as well as the practitioners diverge a lot on the issue of comprehending and applying the denunciation clauses in the ICSID Convention. The critical reason is that they have different understanding of the word “consent” in Article 72 of the Convention. “Consent” in Article 72 of the ICSID Convention shall be interpreted as “offer of consent” or “unilateral consent”. Once the “consent” to subject to ICSID jurisdiction has been given by the host state, it amounts to a compulsory international obligation, and the “offer of consent” becomes irrevocable. The “offer of consent” to subject to ICSID jurisdiction given before the denunciation notice by the denunciation country is acceptable not only before the denunciation, but also during the “waiting period” (between the denunciation notice and effectiveness of the denunciation), and it remains valid even after the denunciation of the ICSID Convention takes effect. But the foreign investments able to “accept” the “offer of consent” made by the denunciation country shall be confined to the ones made prior to the effective date of the host country’s denunciation.
  • 摘要：The environment of the socialist core value identity in new media era is the combination of real world and virtual world. The object of the identity is the information from monopoly by the state to the diversity on the Internet. The method of the identity has changed from inculcating theory systematically by the outside world to reading selective fragmented knowledge actively by the users. The medium of the identity has changed from uniqueness homogeneity to diversity demassification. We should study and follow the rules of the identity in the new media age, strengthen the cohesion of the socialist core values’ content, perform the media function and optimize the environment of identity.%新媒体时代社会主义核心价值观认同环境由现实世界转向现实世界与虚拟世界的结合，认同客体信息源由国家信息垄断到网络信息多元，认同主体的认同方式由外界灌输系统学习为主到自我选择碎片阅读为主，认同载体也由主导载体的唯一性同质化到多样性分众化。要促进社会主义核心价值观的民众认同，必须研究并遵循新媒体时代认同主体对社会主义核心价值观的认同规律，强化新媒体时代认同客体社会主义核心价值观内容的凝聚力，发挥新媒体时代社会主义核心价值观认同载体的功能，优化新媒体时代社会主义核心价值观认同的环境。
  • 摘要：十七年时期散文在时间叙事方面具有鲜明特征，主要表现为时间的意识形态化、历史决定论和历史化方法三个方面。在十七年散文中，时间具有强烈的现实指向性，负载了丰富的意识形态内涵，成为社会意识形态的符码；强调过去—现在—未来的紧密关系，遵行过去—现在—未来的线性发展规律，强调社会历史发展的必然性和规律性，忽略了社会历史发展的偶然性和曲折性；把时间放置在历史进程中进行理解和认识，或者把时间与特定历史阶段进行对比，体现出一种历史主义态度。%The Seventeen-Year Period is a brand-new historical period, which reflected a sharp time sense and history ideas. The time narrating of prose in the Seventeen-Year Period has distinctive characteristics, mainly for the time of ideology, historical determinism and historicized, etc. In the prose of the seventeen years, the time has strong practical orientation, loading rich ideological connotation, and thus becoming the social ideological codes. The works emphasize the close relationship between the past, the present and the future, walk along the past-present-future linear developmen law and emphasize the inevitability and regularity of the social historical development, while ignoring the Contingency and twists of the social and historical development. They place the time in the historical process for understanding and awareness, or compare the time with the specific historical stage so as to understand and process time with historical strategy. Marx’s time theory has important guiding significance on the prose research.
  • 摘要：As a diasporic writer of American new immigrant Chinese writers, Ha Jin chooses to regard and image China of his own expectation from the “Other” perspective when he faces with the cultural conflict in a sense of “dual identity”. He uses memories of childhood to replace the community unconsciousness, and relies heavily on this standpoint to express the root foundation as a typical “diasporic” intellectual, revealing desire for spiritual return to shape the construction of personal value. “China as imagination” in Ha Jin’s writings on the one hand embodies some characteristics, including humanity experiences and art creativities etc.; and on the other hand manifests some limitations. These issues include, but not limited to, the gap between the personal imagination and the community memory, the estrangement between the diasporic identity and native life, and also his English-language texts, thus shaping by the western readers’ horizons of expectations and misunderstandings.%作为在中国长大，后落户美国的流散作家哈金，当面临两栖身份的文化矛盾时，他选择用“他者”的眼光看待和想象心目中的中国，用自己的童年记忆来代替集体无意识，并基于这样的立场来表达一个“流散”知识分子的民族根基感，以求找到精神归宿，实现个人价值。哈金的“中国想象”具有人文体验性、艺术创造性等特点；但同时亦存在个人想象与集体记忆的落差、流散身份与本土生活的隔膜和外文写作之于他国读者期待视野的迎合与误读等局限。
  • 摘要：王世贞引扬雄“诗人之赋丽以则”为“诗人之赋典以则”，明代以来都没有得到注意。实际上这种看似漫不经心的改动，代表着王世贞与扬雄截然不同的辞赋观，也反映了明代中期辞赋领域的一场复古运动。而通过对“典”的独特的学术内涵的解析，可以更清晰地认识这场复古运动的本质：一方面是古典的经学精神对当代轻浮淫靡文风的反哺，一方面又是朝廷吏治精神在文学界的延伸。而在赋学领域，“典”与“丽”的交错有着清晰的演进历程，反映了两种文化精神的平衡和较量。%Wang shizhen changed Yang Xiong’s statement “Fu in the Book of Odes are beautiful and orthodox” into “Fu in the Book of Odes are elegant and orthodox”, which didn’t get enough attention since the Ming dynasty. Actually this seemingly casual changes, represents Wang Shizhen and Yang Xiong different views of Fu, it also reflects a retro movement in the field of Fu in mid-Ming dynasty. Based on the academic connotation of “Dian”, we can know more clearly the nature of the retro movement. On the one hand it is the classical spirit of contemporary Confucianism frivolous decay style of feedback. On the one hand, it is an extension of the spirit of government bureaucracy in the literary world. And in the field of Fu, the crisscross of “Dian” and “Li” has a clear evolution course, reflecting the balance of two kinds of cultural spirit and fight.
