Judge allows suit against use of 'corn sugar' in ads to move forward

Afederal judge will allow to move forward a lawsuit that attempts to block corn refiners from using the term "corn sugar" and "natural" in commercials.The Western Sugar Cooperative, Michigan Sugar Co. and C&H Sugar Company, Inc., filed a complaint in April in the U.S. District Court for the Central District of California, in Los Angeles, against the Com Refiners Association (CRA), Archer Daniels Midland (ADM) Co., Cargill Inc., Com Products International Inc., Penford Products Co., Roquette America Inc. and Tate & Lye Ingredients Americas Inc., arguing that calling high-fructose com sugar "natural" or "com sugar" was misleading. Last month the ADM and several other defendants argued a motion to have the case thrown out in advance of trial (see FCN Sept. 16,2011, Page 3).
