Regulation of foods in the United States can be traced back to the American colonies. When Texas was still a republic, a law regulating the sale of foods was enacted that included the statement, "the selling of flesh of animals not slaughtered or slaughtered when diseased; or any broker, brewer, or distiller selling unwholesome food or drink shall be fined such sum adjudged by the court and for the second offense shall be given 29 lashes on the bare back." I would like to think that we have advancedsocially since then, but there have been times, especially when we were engaged in a contentious administrative hearing, that I had a few nostalgic feelings for the past. In 1883, Texas enacted a statute that prohibited the manufacture and sale of adulterated foods and drugs, and in 1907, the legislature enacted a pure food and drug act that was patterned after the 1906 Federal Food and Drag Act, leading to the creation of a new agency known as the Dairy and Food Commission I am sure that the food and drug laws of most states have gone through a similar evolution.
