Interim rule for settling civil penalties issued

The Federal Mine Safety and Health Review Commission is adopting a Penalty Settlement Interim Rule that is taking out voluminous paper trails and several steps in the process to settlement, resulting in speeding up action needed to close civil penalties assessed under federal laws. Toward that end, the commission is adding several new requirements regarding how parties file settlement motions, while changing others. For example, the interim rule requires that a party filing a motion to approve a penalty settlement also submit a proposed order with penalties included and the proposed motion, all to be submitted electronically.
