PHMSA Issues HM-258A Final Rule to Cease HazMat Operations of Those Who Fail to Pay Civil Penalties

On August 7, 2014, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a final rule in the Federal Register (Docket No. PHMSA-2012-0258 (HM-258A)), amending its hazardous materials procedural regulations. The final rule prohibits a person who fails to pay a civil penalty as ordered, or fails to abide by a payment agreement, from performing activities regulated by the Hazardous Materials Regulations (HMR) until payment is made. The final rule is effective September 8, 2014.
